REGULATIONS AND TERMS OF EMÉ PER TE

PREAMBLE

ATELIER EMÉ Srl, a company subject to the management and coordination of Calzedonia Holding SpA, with registered office in Malcesine (VR), Via Portici Umberto Primo no. 5/3 and administrative headquarters in Via Solferino 83, Castiglione delle Stiviere (MN), VAT Reg. No. and Tax Code. 00157690207, makes discounts, advantages and services available to customers who wish to benefit from them at the “Atelier Emé” stores (both direct and affiliated stores participating in the initiative) and on the website www.atelier-eme.com To benefit from these advantages, you must be a holder of the “Emé per Te” loyalty card (hereinafter also the “Card”): the issuing of the Card and its use are governed by the following conditions (hereinafter also the “Regulations”), which the recipient Customer must read carefully. The activation of the Emé Card, in the manner referred to in point 6 below, implies the Customer's acceptance of these regulations. Atelier Emé Srl reserves the right to periodically modify, even partially, these conditions and the related amendments will come into force after 10 (ten) consecutive days from their publication on www.atelier-eme.com In the event that the Customer does not accept the changes, they will have the right to cancel their registration, a right which, they are entitled to at any time as specified below. The use of the Card, after changes come into effect, implies acceptance, by actions construed as consent of the changes made. Atelier Emé Srl also reserves the right to temporarily or definitively suspend this loyalty program, at any time, without the Customer being able to make any complaints in this regard (without prejudice, only respecting rights already acquired by the participants at that moment), by communicating it on its website www.atelier-eme.com and/or at the points of sale participating in the initiative. These Regulations are always available for consultation at the address www.atelier-eme.com.

2. PARTICIPATION CHANNELS

  • • All stores under the "Atelier Emé" brand, whether managed directly by Atelier Emé Srl (so-called "direct stores"), or affiliated and, therefore, managed by other company names (so-called "affiliated stores"), which adhere to the initiative by displaying the relevant advertising and information material. The list of stores taking part in the initiative can be viewed on the website www.atelier-eme.com • E-commerce website www.atelier-eme.com

    4. TYPE / NAME / PURPOSE OF THE INITIATIVE / DURATION

    This is a promotional initiative consisting of a loyalty program that recognizes exclusive advantages for holders of the loyalty card called "Emé per Te". The aim of the initiative is to build customer loyalty through a loyalty program that provides benefits for card holders. Without prejudice to what is specified in the preamble, in point 7 ("Operation and benefits") and in point 8 ("Program interruption - Card deactivation - Miscellaneous"), the "Emé per Te" Card is not subject to expiry.

    5. RECIPIENTS

    End customers who are adults and obtain the Card according to the registration and operating methods indicated below.

    6. REGISTRATION MODE

    The “Emé per Te” card will be issued to the Customer in digital format directly from the point of sale or by accessing the website www.atelier-eme.com. Online registration for the "Emé per Te" loyalty program will require the creation of a specific account on the brand's e-commerce website. The registration systems will prevent underage customers from registering on the loyalty circuit. The Card is personal and non-transferable. Customers cannot activate more than one card during validity. The Card is for private, non-commercial use only. The Customer may freely request to be removed from the loyalty program at any time by contacting customer care on 045 45200021 or access their reserved area and carry out the cancellation independently.

    7. OPERATION AND BENEFITS

    The Card will give the customer the opportunity to benefit from numerous discounts, promotional operations, prize operations and designated special initiatives, which will be adequately advertised and communicated in each case. The Customer can take advantage of the designated benefits simply by communicating their name to the store staff or by accessing the designated area on the website www.atelier-eme.com. In particular, the following discounts are described below: Welcome Discount: 10% discount on your first purchase online, valid for 90 days from its issuance (not applicable on items already subject to discounts or promotions). Birthday Discount: 20% discount for a Ceremony purchase in the period between 30 days before and 7 days after the birthday date (not applicable on items already subject to discounts or promotions). Any communication relating to participation in the loyalty program and strictly indispensable for the provision of the services related to it (such as, for example, confirmation of registration/cancellation, attribution of designated discounts or reserved free gifts) should be understood as necessary for the carrying out of the program itself. Therefore, by accepting these regulations, the Customer consents to receiving said communications which will be sent to the contact details indicated in the program registration form. The refusal to receive these communications makes it impossible for Atelier Emé Srl to implement the program and provide the services connected to it. Any refusal expressed during the course of the program will result in its automatic interruption.

    8. PROGRAM INTERRUPTION - CARD DEACTIVATION- MISCELLANEOUS


    Atelier Emé Srl reserves the right to modify, suspend or discontinue the loyalty “Emé per Te” program and the related services at any time and at its discretion. Appropriate communication will be given of such modifications, suspensions or interruptions by placing a suitable notice on the website www.atelier-eme.com and/or in the points of sale participating in the initiative. Without prejudice to any other right provided for by law, including the right to compensation for damages, Atelier Emé Srl may revoke the Customer's right to use the Card and deactivate it in the event of use of the Card in violation of the conditions set out in these Regulations or in the event of unauthorized or harmful use of the "Atelier Emé" image and brand. Furthermore, the Card is automatically deactivated in the event of non-use or inactivity by the Customer for a period exceeding 5 years. In the event of revocation and deactivation, the Customer will no longer be able to use the benefits and services of the Card. Atelier Emé Srl is not responsible for any consequences, direct or indirect, connected to malfunctions of the loyalty program beyond its control. Atelier Emé Srl is not responsible for any fraudulent, improper or unauthorized use of the Card. .

    8. PERSONAL DATA PROCESSING


    What Personal Data will we use?
    Your participation in the Emé per Te promotional initiative involves our use of personal data relating to you. In particular, to allow your registration with "Emé per Te", we need to process the data you provide us with at the time of registration. For registration via the website www.atelier-eme.com, failure to provide the data indicated with an asterisk in the registration form will make it impossible to complete the registration process; for registration carried out in "Atelier Emé" stores with the assistance of sales staff, the e-mail address, telephone number, preferred point of sale and date of birth are mandatory data. With your consent, we may also use other information you freely provide to us at the time of registration or relating to the ways in which you interact with us (hereinafter, collectively, the "Data"). More specifically, we can collect:
    • the optional information requested through the web registration form or, in the case of registration made in the Atelier Emé stores through the assistance of the sales staff, the name, surname, country, region, date of marriage, favourite collection constitute optional information;
    • the information acquired by examining your interaction with us, through e-mails and newsletters, through our Internet sites and through the Apps that may be developed by us or by third parties (for more information, please consult the relevant privacy policies);
    • any information you may share through the social networks to which you are registered.
    For what purposes will we use your Data and on the basis of which legal requirements?
    We will use your Data, also by electronic means, for the following purposes:
    a) Loyalty Program Management: Your Data will be used in order to provide you with discounts and other advantages, which may be provided to your benefit and, more generally, for all contractual and administrative obligations related to the initiative.
    b) Personalized assisted sale in any store where the initiative is active: Wherever you are, you can receive help and advice from our sales assistants, with information (e.g. size, colour or model) on the items purchased during the last 36 months in any Emé per Te store and also online. Considering that Atelier Emé is a global brand, this use of your Data, based on our legitimate interest, allows us to improve the quality of our services at the point of sale, and guarantee a uniform service to our customers who have signed up to the initiative at all our points of sale. In any case, if you do not wish to receive this assistance, simply ask that your Data not be used for this purpose at the time of registration or also at a later time.
    c) With your consent, we may also use your Data for the following purposes: a. Direct marketing: to send you, through the contact details provided, newsletters, information relating to the products and services provided by our company, offers and promotions, as well as to conduct market research. We may, for example, send you e-mails or messages (e.g. SMS and WhatsApp) or send you promotional materials to your postal address and contact you by telephone through an operator. On this occasion you may receive offers and promotions relating to products marketed by the entire Calzedonia Group (such as Calzedonia, Intimissimi, Tezenis, Falconeri, Signorvino, Antonio Marras). b. Profiling: to examine your preferences, the ways in which you interact with us and your purchasing behaviour. In particular, in order to better understand your tastes and interest in our products and our communications, we will be able to examine - also through the use of automated systems - the information provided at the time of your participation in the Emé per Te initiative, the purchases made at our stores over the last 3 years, your interest in the communications and newsletters that we will send you, the frequency with which you visit our websites, the way you use our Apps and your interest in our social media channels (e.g. Instagram, TikTok, etc.). For more information on the data that we may acquire through browsing our websites and/or using our apps, you can consult the relevant privacy policies. Finally, we may enhance your profile with statistical information that we can lawfully acquire from other sources: for example, in relation to your area of residence (such as demographic information, geo-referencing data, etc.) or the electronic tools that you use to interact with us. In any case, this profiling activity is aimed at better personalizing our services and does not entail legal or other significant effects for you. Your membership of Emé per Te is in no way conditional on the provision of the consents referred to above. How long will we keep your data?
    Your Data will be processed no longer than is necessary to manage your participation in the Emé per Te promotional initiative (and if you have not objected to the personalized assisted sales service for 36 months). Furthermore, if you have given consent to direct marketing, the Data will be processed until said consent is revoked. If, however, you have given consent to profiling, we will retain the data relating to your interactions with us for 12 months starting from the date of collection, while the information relating to your purchases will, however, be kept for 3 years starting from the date of execution of each purchase. To whom will we communicate your Data?
    For the purposes of managing your participation in Emé per Te and for administrative purposes, we may communicate your Data to our service providers (e.g. IT services) and to the companies that manage the Atelier Emé sales points where the initiative is active and to other third parties where there is a legal obligation to do so. A complete list of these companies will be made available by sending a written request to the contacts indicated below. How will the transfer of your data to non-EU countries be regulated?
    Your Data may be transferred outside the territory of the European Union, including to countries where the level of protection of personal data may be lower than that guaranteed by European legislation. This transfer will take place, in any case, in compliance with adequate guarantees for the protection of your data and, in particular, with the standard contractual clauses approved by the EU Commission with decision no. 2010/87/CE (https://www.garanteprivacy.it/documents/10160/10704/176700). What rights can you exercise?
    You have the right to request access to the Data, rectification or deletion of the same, limitation of processing and to object to its use by us, as well as the right to request the delivery of some of the data. Rights of the Interested party: • Right of access
    The interested party has the right to obtain confirmation from the data controller as to whether or not personal data concerning them is being processed and, in this case, obtain access to the personal data and the following information: i. the purposes of the processing;
    ii. the categories of personal data in question;
    iii. the recipients or categories of recipients with whom personal data has or will be communicated, in particular if recipients are from third countries or international organizations and, in this case, the existence of adequate guarantees;
    iv. when possible, the envisaged retention period of personal data or, if this is not possible, the criteria used to determine this period;
    v. the existence of the interested party’s right to ask the data controller to rectify or delete personal data or limit the processing of personal data concerning them or to oppose its processing;
    vi. the right to lodge a complaint with a supervisory authority;
    vii. if the data is not collected from the interested party, all available information on its origin;
    viii. the existence of an automated decision-making process, including profiling, which produces legal effects concerning them or similarly significantly affects them and, at least in such cases, significant information on the logic used, as well as the importance and consequences provided for this processing for the interested party.
    • Right to rectification
    The interested party has the right to obtain the rectification of inaccurate personal data concerning them without unjustified delay from the data controller.
    • Right of cancellation
    The interested party has the right to obtain the erasure of personal data concerning them without unjustified delay from the data controller and the data controller is obliged to erase personal data without unjustified delay, if one of the following reasons exists:
    i. the personal data is no longer necessary in relation to the purposes for which it was collected or otherwise processed;
    ii. the interested party withdraws the consent on which the processing is based and there is no other legal basis for the processing;
    iii. the interested party objects to the processing, and there is no overriding legitimate reason to proceed with the processing;
    iv. the personal data has been processed unlawfully;
    v. to fulfil legal obligation under European Union law or the law of the Member State to which the data controller is subject the personal data must be erased;
    • Right of processing restriction
    The interested party has the right to obtain processing restriction from the data controller when one of the following cases occurs:
    i. the interested party disputes the accuracy of the personal data, for the period necessary for the data controller to verify the accuracy of the aforementioned personal data;
    ii. the processing is unlawful and the interested party opposes the deletion of the personal data and instead requests that its use be limited;
    iii. although the data controller no longer needs it for the purposes of processing, the personal data is necessary for the interested party to ascertain, exercise or defend a right in court;
    iv. the interested party has objected to the processing, pending verification of the possible prevalence of the legitimate reasons of the data controller over those of the data subject.
    • Right to object
    The interested party has the right to object at any time to the processing of personal data concerning them based on the legitimate interest of the owner, including profiling. Furthermore, the interested party has the right to object to the processing of personal data concerning them at any time, carried out for direct marketing purposes, including profiling to the extent that it is connected to said direct marketing.
    • Right to data portability
    The interested party has the right to receive personal data concerning them provided to a data controller in a structured, commonly used and machine-readable format and has the right to transmit said data to another data controller without impediments on the part of the data controller to whom it was provided if: i) the processing is based on consent or a contract;
    And
    ii) the processing is carried out by automated means. In exercising their rights regarding data portability, the interested party has the right to obtain the direct transmission of personal data from one data controller to another, if technically feasible.
    • Right to lodge a complaint with the competent Supervisory Authority
    In the event that the interested party believes that the processing relating to their personal data is carried out in contrast with the provisions of EU Regulation 2016/679, they can lodge a complaint with the competent Supervisory Authority for the protection of their rights.
    How can you change your preferences or withdraw consent?
    You can check, modify or revoke your consent in relation to the purposes referred to in letter (c) (“Direct Marketing” and “Profiling”) (also declaring that you do not wish to receive commercial information via e-mail and/or instant messaging) and/or request that your Data not be used for the purposes referred to in letter (b) (“Personalised assisted sales”) at any time. For those registered via the website www.atelier-eme.com these operations will be possible:
    • via the account used for registration, in the section dedicated to your privacy preferences;
    • by contacting the address privacy@calzedonia.com or the Data Protection Officer at the address dpo@calzedonia.com
    • By contacting our customer service.
    For those registered in the Atelier Emé sales points, through the assistance of the sales staff, these operations will be possible:

    How to contact the Data Controller?
    The Data Controllers of your personal data for the purposes indicated above are:
    • Calzedonia S.p.A with registered office in via Portici Umberto Primo 5/3 Malcesine (Verona, Italy) and
    administrative office in Via Monte Baldo no. 20 Dossobuono of Villafranca (Verona, Italy); And
    • Atelier Emé S.r.l. with registered office in Malcesine (VR), Via Portici Umberto Primo no. 5/3 and administrative office in Via Solferino 83, Castiglione delle Stiviere (MN).
    Calzedonia S.p.A. and Atelier Emé S.r.l., as part of the Emé per Te promotional initiative, are therefore joint controllers of the processing of your personal data, as they jointly determine the purposes and means of processing. The joint controllers have entered into a joint controllership agreement pursuant to Article 26 of the GDPR, the essential content of which is available to you at the offices of the joint controllers.     How to contact the Data Protection Officer?
    You can contact the Data Protection Officer by sending a communication to the following address: DPO@calzedonia.com. How will you be informed of any changes to this Privacy Policy?
    This Privacy Policy may be subject to changes and updates if changes are made to the way we process your Data or to the other information provided to you herein. Any changes will guarantee, in any case, full protection of your rights. If changes are made that may limit the guarantees for the protection of your Data or your rights with respect to the current version, before the processing of your Data begins according to the new methods, you will be promptly informed through the contact details provided and you will be guaranteed the right to unsubscribe from the Emé per Te initiative, in any case, to change your consent and your preferences. In any event, we invite you to consult the updated Privacy Policy published on the website www.atelier-eme.com from time to time.
